In this first meditation, he presents what is in doubt, opening the mediation with several falsehoods that believed in his life and further faulting of the knowledge that he built on those falsehoods. The mediator sweeps all his former knowledge away, sits himself and decides to build up his knowledge. However, as he realizes from so doing, he establishes that, all the things that he learned in the past came through his senses. He continues further to doubt the foundations of all opinions that he founded on his senses, acknowledging that the senses can deceive. PBA Murr vs Wisconsin Case Analysis Adem Mehmetaj I. The question being asked is should two legally distinct but commonly owned contiguous lots of land be combined for takings analysis purposes? Joseph P. Murr and his family bought 2 lots approximately the same size and at different times. The issue before us is that Murr no longer wishes to hold one of the lots and St. Croix rules that he is not allowed to sell only one of the lots due to environmental concerns. Petitioners claim that state and federal courts are in substantial conflict with respect to the issue at hand and cite numerous cases in an attempt to derive support for their proposition. Those cases as well as the examples provided below all involve different facts and circumstances. They confirm that a flexible, ad hoc, approach has consistently been used by the lower courts to define the relevant property and to determine whether compensation is due. The Wisconsin appellate court ruled that because the two lots are contiguous, and happen to be owned by the same people , this Courts parcel as a whole rule from Penn Central requires combining the two parcels for takings analysis. From the Murrs perspective, Lots E and F are two separate parcels, created as legally separate lots, taxed separately, and purchased separately. The lots were never developed together, and were purchased for completely different reasons. Nevertheless, because the Murrs own both parcels, the Wisconsin court ruled that these two parcels combined were the Murrs parcel as a whole. This conclusion was driven by the contiguous ownership. II. The parents of Joseph P. Murr and his siblings (the Murrs) purchased two adjacent lots (Lots E and F) in St. Croix County in 1960. The two lots together made up approximately .98 acres. In 1994 and 1995 respectively, the Murrs parents transferred Lot F and Lot E to their children. In 1995, the two lots were merged pursuant to St. Croix Countys code of ordinances. The relevant ordinance prohibits the individual development or sale of adjacent lots under common ownership, unless an individual lot was at least one acre. The ordinance further specified that if each lot is not at least one acre, the lots may be measured together to equal one acre. Seven years later, the Murrs wanted to sell Lot E and not Lot F. The St. Croix County Board of Adjustment denied the Murrs application to sell the lots separately. The Murrs sued the state and county and claimed the ordinance in question resulted in an uncompensated taking of their property and deprived them of all, or practically all, of th e use of Lot E because the lot cannot be sold or developed as a separate lot. The circuit court granted summary judgement to the state and county. The Court of Appeals of Wisconsin affirmed and held that the Murrs were not deprived of their practical use of the property. Nevertheless, Petitioners submitted their plan to the St. Croix County Board for consideration. The Board denied their plan and refused to make an exception to the longstanding regulations. Instead of modifying the plan or submitting a less-intrusive plan that complied with the existing regulations Petitioners filed this lawsuit alleging a regulatory taking. The Supreme Court confirmed the parcel as a whole rule in Keystone Bituminous Coal Association v. DeBenedictis, where coal operators asserted that a court should only consider the coal that could not be mined to determine whether a state law requiring them to leave a certain amount of coal in the ground amounted to a regulatory taking. The Supreme Court again endorsed the parcel as a whole rule in Concrete Pipe Products, Inc. v. Construction Laborers Pension Trust. There, Concrete Pipe claimed that a regulatory taking occurred when federal law required it to pay withdrawal liability to a pension trust. In 2006, the Murrs brought suit in St. Croix County Circuit Court, which ruled against them and affirmed the Zoning Boards decision denying the variance to sell or use the two lots as separate building sites. The Murrs claim that since Lot E and F were created as legally separate lots purchased separately for different purposes and taxed separately, they should also be able to sell them separately. The Murrs reject the claim that Penn Central v City of New York[1] established a rule stating that two legally distinct properties should be considered as contiguous parcels. Under Penn Central, to determine whether a particular government action has accomplished a taking, courts are to focus both on the character of the action and on the natur e and extent of the right interference with rights in the parcel as a whole. [2] On appeal in 2011, the Wisconsin State Appellate Court once again upheld the boards decision. It held that the two lots are contiguous and also happen to be owned by the same people, so implementing the Courts parcel as a whole rule from Penn Central does in fact require combining the two parcels for takings analysis. Furthermore, the Court of Appeals rejected the petitioners notion that the lots had not merged as a result of the Grandfather Clause because the lots were already subject to the 1976 environmental regulation when they had been merged under joint ownership in 1995. The Appellate Court ruled that it was not a taking because the Murrs property, taken as a whole, could be used for residential purposes, among other things. [3] The circuit court had also stated that a year-round residence could be built on top of the bluff and the residence could be located entirely on Lot E, entirely on Lot F, or could straddle both lots. [4] III. The Takings Clause of the U.S. Constitution states simply nor shall private property be taken for public use, without just compensation. However, that clause has taken on a distinguished role in constitutional jurisprudence, notably with relation to the boundaries of state and native restrictive power. Any discussion of the Takings Clause ought to begin with the history that led to its enactment and therefore the approach case law has developed. The Takings Clause found its origin in Section 39 of the Magna Carta, which declared that land would not be taken without some form of due process: No freemen shall be taken or imprisoned or disseised or exiled or in any way destroyed, nor will we go upon him nor send upon him, except by the lawful judgment of his peers or by the law of the land. The Fifth Amendment was solely a restriction against the central. Whereas there have been some limits on the powers of the States before 1865, the Civil War caused the federal government to rest rict the powers of the state governments against their own voters through the passage of the Thirteenth, Fourteenth, and Fifteenth Amendments. The Fourteenth Amendment created restrictions to the States through Due Process clause. The Due Process Clause gradually shifted. One shift was procedural and was developed to assure that hearings and alternative governmental decision-making processes were conducted fairly. This review of the processes of government is understood as procedural due process of law. A second line of cases extended the boundaries on the federal government within the Bill of Rights to state and local government action exploiting the Due Process Clause. For roughly one hundred years after the passage of the post-Civil War amendments, The Due Process Clause judicial proceeding resulted in incorporation of a number of the restrictions on the federal government within the Bill of Rights to state and local actions moreover. The Supreme Court applied the Takings Clause of the Fifth Amendment to the States through the Fourteenth Amendment Due Process Clause in Chicago Burlington and Quincy R.R. v. City of Chicago, 166 U.S. 226 (1897). Beginning with Mugler v. Kansas, 123 U.S. 623 (1887), during which the U.S. Supreme Court indicated that that Court may review, through the due process of law Clause, the substance of legislation. To review both the procedure as well as the substance of legislation can be referred to as substantive due process. This part of the Due Process Clause allows judges to second-guess state and local legislative decisions. Under substantive due process, a court may verify whether or not the ends and means of legislation were acceptable and whether or not the legislation was unduly oppressive to regulated parties.In Kelo v. city of new London, 125 S. Ct. 2655 (June 23, 2005), the question arose on whether or not the utilization of eminent domain alone for economic development purposes may be a valid public use. Any regulations placed on ones property does indeed infringe on their right of land. That does not mean however it can be deemed a taking. Takings Clause is tricky, because it is not always clear what is a taking and what is not. The unclear interpretation of what a takings is expected to remain in an unpredictable path. IV. St. Croix County and the State of Wisconsin cite numerous environmental interests with the regulations in question. According to the St. Croix County Zoning Board, granting the Murrs the variance could result in yet another residence with access to the river, additional tree cutting and excavating, and another sanitary system in an area with serious limiting factors. We must discuss if these environmental interests are legitimate in preventing landowners from selling. We must decide to either uphold or reverse the Appellate Courts decision that Penn Central, whose building and airspace were considered contiguous parcels, establish a rule that is applicable to the case in question. Furthermore, we must decide if under Lucas v South Carolina Coastal Council,[5] in which the land essentially useless, the Murrs could be entitled to Monetary compensation. Congress enacted the National Wild and Scenic Rivers Act (Act) in 1968 to preserve certain rivers for the enjoyment of present and future generations, to wit: It is hereby declared to be the policy of the United States that certain selected rivers of the Nation which, with their immediate environments, possess outstandingly remarkable scenic, recreational, geologic, fish and wildlife, historic, cultural or other similar values, shall be preserved in free-flowing condition, and that they and their immediate environments shall be protected for the benefit and enjoyment of present and future generations. The Congress declares that the established national policy of dams and other construction at appropriate sections of the rivers of the United States needs to be complemented by a policy that would preserve other selected rivers or sections thereof in their free-flowing condition to protect the water quality of such rivers and to fulfill other vital national conservation purposes.[6] Under both cases, I suggest that we uphold the Boards original decision in 2005. As the circuit and appellate courts both stated, aft er the lots were placed under common ownership as contiguous parcels, they are subject to the countys current zoning regulations. In 1986, Lucas bought two residential lots on the Isle of Palms, a South Carolina barrier island. He intended to build single-family homes as on the adjacent lots. In 1988, the state legislature enacted a law which barred Lucas from erecting permanent habitable structures on his land. The law aimed to protect erosion and destruction of barrier islands. Lucas sued and won a large monetary judgment. The state appealed. Since unlike Lucas, the Murrs may build on both parcels and sell them together for a reasonable price, there is no need for compensation. Furthermore, the Countys environmental interest outweighs that of Murrs. Just v. Marinette County, 56 Wis. 2d 7, 201 N.W.2d 761 (1972), a shoreland zoning ordinance established a conservancy district over wetlands within 1,000 feet of a lake and prohibited any filling without a permit. This, in effect, prev ented the changing of the natural character of the land à ¢Ã¢â€š ¬Ã‚ ¦.[7] The landowner asserted the ordinance was unconstitutional because it amounted to constructive taking without compensation. The court disagreed, finding the ordinance a valid exercise of the police power to protect navigable waters and the public rights therein from the degradation and deterioration which results from uncontrolled use and development of shorelands.[8] In Penn Central, New York Citys landmark preservation interest outweighed the use of airspace as a skyscraper. V. Based on the foregoing, we conclude the circuit court properly granted summary judgment in favor of the County and State of Wisconsin. The undisputed facts establish that the Murrs property, viewed as a whole, retains beneficial and practical use as a residential lot. Juvenile Recidivism Essay -- delinquency, rehabilitation, Risks Assess

Introduction: Recidivism or, habitual relapses into crime, has time and time again proven to be an issue among delinquents, which thereby increases the overall juvenile prison population. This issue has become more prevalent than what we realize. Unless a unit for measuring a juvenile’s risk of recidivism is enacted and used to determine a system to promote effective prevention, than the juvenile prison population will continue to increase. Our court system should not only focus on punishing the said juvenile but also enforce a program or policy that will allow for prevention of recidivism. So the question remains, how can recidivism in the juvenile prison population be prevented so that it is no longer the central cause for increased juvenile delinquency? Simply put, we must create a means of measuring juvenile’s level of risk and in turn, form an effective rehabilitation program that will decrease their risk level for future recidivism. Show the problem exists: â€Å"Critics of the juvenile justice system claim that approximately 500,000 youths who move through to the nation’s pretrial detention centers each year—70 percent of them nonviolent offenders—are thousands too many and that this experience may even increase the chances that they will commit more crimes and go â€Å"deeper† into the system† (Hardy 2007). These numbers are staggering. Of these half a million youths 350,000 of them will be re-incarcerated in just a matter of 12 months or less. This is an epidemic that can no longer be avoided. Evolution of Health Care Information Essay

Over the last 20 years dramatic changes have occurred in the health care industry. â€Å"Health care technology has exploded over the last 20 years, not just in the arena of medical diagnosis and treatment, but also in the area of health information and documentation† (The art of patient care, 2008, p. 1). Two Major Events Twenty years ago, Riverview Hospital was limited with technology. The use of paper files for patient records is a thing of the past. Today Riverview Hospital uses electronic medical records (EMR). â€Å"An EMR is able to electronically collect and store patient data, supply that information to providers on request, permit clinicians to enter orders directly into a computerized provider entry system, and advise health care practitioners by providing decision-support tools such as reminders, alerts, and access to the latest research findings, or appropriate evidence-based guidelines† (Wagner, Lee, & Glaser, 2009, p. 1). â€Å"Paper-based records have been in existence for centuries and their gradual replacement by computer-based records has been slowly underway for over twenty years in western healthcare systems† (Open Clinical, n.d., p. 1). Riverview Hospital has also seen an increase in using personal digital assistants (PDAs). Twenty years ago, PDAs did not exist. Doctor’s and other health care providers had to look up information in books and other publications. â€Å"The use of personal digital assistants (PDAs) in medicine and the health sciences has rapidly increased. Health care professionals are using PDAs for patient tracking, medical reference, and drug dosage, as well as personal use† (Journal of the Medical Library Association, 2004, p. 1). â€Å"Health care personnel need access to updated information anywhere and at any time, and a Personal Digital Assistant (PDA) has the potential to meet these requirements. A PDA is a mobile tool which has been employed widely for various purposes in health care practice, and the level of its use is expected to increase. Loaded with suitable functions and software  applications, a PDA might qualify as the tool that personnel and students in health care need† (PubMed, 2008, p. 1). â€Å"According to a May 2002 article in BNET, PDA software enables health care professionals to store patient information, order prescriptions directly to pharmacies, check on lab results and access medical information remotely. PDA programs even allow health care professionals to document billing and claims encounters to be submitted to health plans† (eHow, 2010, p. 1). The EMR system can connect doctors in a single practice and then share patient data with clinics, hospitals, and pharmacies if their systems are linked and compatible. EMR and PDA With the implementation of the EMR and the PDA, Riverview Hospital has seen an increase in the number of patients. Although patient stays have decreased, the number of patients which pass though the hospital has increased. The average stay today is half of what it was 20 years ago. â€Å"With the introduction of technology, health care providers have the ability to look up almost any aspect of medical information needed at the touch of a button† (The art of patient care, n.d., p. 1). The EMR implementation at Riverview Hospital has improved quality, outcomes, and safety. The EMR has improved efficiency, productivity, and cost reduction. The EMR has also improved service and satisfaction. â€Å"With PDAs, health care professionals can provide quality medical services to patients that are efficient and effective. PDAs offer instant access to critical information, so patients do not have to wait long to hear back from their doctors about lab test results or their prescription needs† (eHow, 2010, p. 1). One has to take into consideration with the EMR and the PDA that HIPPA is not violated. Although with the introduction of the EMR, it is less likely to see HIPPA violations as compared to paper charts. â€Å"Health care professionals who use PDAs must be careful to properly secure their electronic devices in a way that complies with the Health Insurance Portability and Accountability Act† (eHow, 2010, p. 1). President Obama has pledged that every American will have an electronic medical record by 2014. Twenty years ago, this was not even a  consideration. President Obama sees health care information technology and electronic medical records as key to improving the quality of care while reducing costs. This implementation will not only improve care coordination that will lead to better health care (reduced cost, enhanced quality), it will create jobs. Barriers The EMR and the PDA can also cause barriers within the health care system. Some of the barriers are resistance. This resistance was seen among health care practitioners at Riverview Hospital, although the implementation happened. There may be technical matters that occur, financial matters, resource issues, training and re-training issues, certification, security, ethical matters, and confidentiality issues. There may also be incompatibility between systems and doubts on clinical usefulness. Conclusion Remarkable advances in medical technology, especially at Riverview Hospital, continue to transform health care delivery. With this transformation comes many issues that arise. The EMR and the PDA can enhance how health care is delivered and can pose both positives and negatives. Within the 20 years at Riverview Hospital much has changed with technology and information systems, although one thing remains the same, the mission to treat patients as well as to improve and preserve the health and well-being of those they serve. Essay on the Concept of Power

We know for certain that it proves as the one thing that either keeps people together, makes them revolt, or changes history overall. But what is it really? Is it the ability to do or act, or is it political/national strength? Does it always have to be represented by a person in charge? Or is it just something in our minds that has the possession to control our influence. There are so many meanings behind this short yet ‘powerful’ word, such as that which is discussed in Orwell’s Animal Farm, and that which is part of human nature. To begin with, various resources provide different illustrations of power. Reading George Orwell’s Animal Farm, it gives us the view of power in a form of an animal representing us humans. A short summary of the book is that of how one animal, a pig, in the whole bunch has the courage to stand up and feed the other animals with brainwashing information. He begins with things that amuse the group which was mainly equality for all. Since the farmer was in charge of the animals’ lives, the pig reaches out to them in their weakest point by promising them freedom and equality. The pig does this only so the others will agree with every other decision he makes. Time after time, he slowly changes the rules here and there, still pretending to be egalitarian. The rest of the animals are so convinced that they are being led towards the right path from the beginning, they never stop to analyze what they were actually doing, which was whatever they were told by the pig. Eventually they are brought back to the same position by their own kind, as they had been in the beginning by the farmer: following the dictates of a single individual. Thus, according to Animal Farm, we come to understand that power is simply something that is passed on in life. In the story, it was the one thing that kept the animals together doing whatever they were told. If any animal became somewhat suspicious of someone daring to stand up to the leader, they were thrown out immediately. Yet, from the reader’s point of view, it is what causes mayhem in our minds to know that we, as people, are fooled the same way by everyday things. You realize how brainwashing is used and devoured by those who don’t contemplate the consequences of authoritarian regimes. Now, if we â€Å"zoom in† to the big picture, power has a role in each tiny event of our daily lives. Every one of us wants and needs power to show our importance and presence. It is our egos drug. It begins very early in our childhood, when we first start to explore the limit of our power. A little child crying very loudly, for example, waits to see when mom or dad lose their patience and say stop or no. Until then it is not going to stop crying, which shows how we use our power, even if it’s only for some more candy. Later on, that child, lets name her Visvira (which in Latin stands for power), is going to build friendships with other children. Even in the Sandbox there is a hierarchy. Everyone has his/her role; the stronger children like Visvira, who maybe have a lot of power at home, will most likely use it in relation with other children too, and are the unofficial leaders of the whole bunch. It doesn’t even have to be a bunch. In many cases of a friendship of two people, one is always more powerful than the other and time and again it shows, for example, when telling his/her weaker friend what to do. Power rules the world, and as said before it starts with every one of us. We all have the need for power, beginning with the power of controlling ourselves. Visvira is going to grow up, and have many arguments with her parents, which mostly start because she wants more power for herself. She wants to decide more on her own, and her parents are often afraid of giving her too much power. When Visvira has collected that much knowledge to know that it’s not always best to decide everything on her own, she is called an adult. In adulthood power still shows, but differs from the naive use in childhood. Adulthood power is weighed more definite. Visvira is in her first real relationship where she just started to go out with her new boyfriend. From the first day on, each side shows indirectly his and her strengths and powers. What they’ve learned until now is that one always has to give in, if it’s worth the sacrifice. Visvira’s boyfriend for example learned this earlier in his teenage-years, and decided to be the weaker one, who’d rather do what the powerful tell them to, than risk on his own. Hence, Visvira turns out to be dominant in the relationship. She decides what they’re going to do, when, and why. Visvira got so good in using her power it’s even helping in her career. The power she has at home with her family and with her boyfriend gives her confidence and strengthens her so much, that she’s not afraid of being dismissed when coming up with new ideas. After Visvira and her boyfriend move in and get married, she even makes more money than him, which presents another big presence of power. Her life goes on like this when they have children too. She keeps on making the decisions because she wears the pants in the family. But as her children grow up, guess what they’re going to do? Like their mother, they’re going to fight for their own power, and Visvira gets to her last part of life: â€Å"Senior-hood†. She knows now, she isn’t the boss anymore, but the power she lost is given to her back in love and respect. â€Å"All animals are equal, but some animals are more equal than others (Orwell 133). As the most influential quote in the entire book, it shows the reality of by what rules our world operates. Orwell is known as an author who tries hard to show readers his view on society and how easily fooled it becomes when there is only one individual in power. King recognized that the March, with an attending crowd of over 200,000 as well as a national television audience, would be the perfect opportunity to gain support for the civil rights movement. He intended to persuade his audience of the justice of the cause, encourage them to not abandon hope, and warn them that in the process of gaining our rightful place we must not be guilty of illegal deeds, declaring his belief that nothing positive is accomplished through violence King. He designed his speech with those goals in mind. Kings understanding of the size and composition of his audience determined the rhetorical choices he made while composing his speech. It is important to understand that while hoping to influence the attitudes of an entire nation, King was primarily addressing a black audience. He spoke of generations of injustice, and referring to the recent increase in violence, stressed the importance of remaining non-violent. He warned against an attitude of distrust toward our white brothers who have come to realize that their freedom is inextricably bound to our freedom as evidenced by their presence here today. He is obviously speaking directly to black Americans. Because of this focus, King made rhetorical choices he knew would be familiar to a black audience with a shared cultural background. Those choices have proven powerful to people of all races, but they were selected with a black American audience in mind. The reasons for Kings rhetorical choices are frequently attributed to their special impact on black Americans, but it should be worried that the effectiveness of these choices crossed all racial boundaries. King knew an emotional speech would have greater impact upon a large, outdoor crowd. He presented a beautiful and compelling vision of equality that inspired the crowd, expanded his national audience and ensured their attention to future messages. He wanted to reach the masses and did so. To inspire the crowd, to instill his speech with an emotional and spiritual quality, King utilized the delivery style of the black folk pulpit of which he was master. King, a master stylist, used a variety of rhetorical techniques in his speech. I Have a Dream needed to touch a wide range of people: people from different geographical locations, with different education backgrounds, of different color. King anticipated the importance of the March, knew he had a real opportunity to be heard by millions. He recognized the difficult demographics of the situation. The audience would be enormous and distractions would be inevitable in the wide open outdoor location. He also understood that the patience of black Americans was too sorely tried: black Americans would no longer be pacified with mere promises. And while understanding their frustration, King passionately wanted to convince the crowd to pursue their cause without violence. Because he understood of all of this, King chose not to focus on detail, not to focus on strategy. He appealed to the crowds higher emotions of spirituality and patriotism. God was on their side, their struggle would be rewarded. Currently, â€Å"I Have a Dream† is still considered a deep work studied in both literature and speech classes. â€Å"I Have a Dream† is a masterpiece which describes, with wisdom and compassion, a peoples long struggle for equality.

A History of the Palace of Versailles, the Jewel of the Sun King Beginning as a humble hunting lodge, the Palace of Versailles grew to encompass the permanent residence of the French monarchy and the seat of political power in France. The King’s Apartments (1701) Built as the private residence for the king within the Palace of Versailles, the kings apartments featured gold and marble detailing as well as Greek and Roman artwork intended to represent the king’s divinity. The Hall of Mirrors represents the enormous wealth of the French monarchy, as mirrors were among the most expensive belongings during the 17th century. Patronage to Versailles by courtiers dropped off quickly, fueling the flames of the budding revolution. In 1789, Marie-Antoinette was in the Petite Trianon when she learned of the mob storming Versailles. Both Marie-Antoinette and King Louis XVI were removed from Versailles and guillotined in the subsequent years. Marie-Antoinette altered the appearance of the queen’s apartments several times during her reign. Most notably, she ordered the construction of a rustic village, The Hamlet of Versailles, complete with a functioning farm and Norman-style cottages. Marie-Antoinette’s Hamlet featured Norman-style cottages, including one for her exclusive use.   Heritage Images / Getty Images Versailles During and After the French Revolution (1789 -1870) After King Louis XVI was guillotined, the Palace of Versailles was forgotten for almost a decade. Most of the furniture was either stolen or sold at auction, though many of the paintings were preserved and brought to the Louvre. In 1804, Napoleon Bonaparte was coronated as the first emperor of France, and he immediately began the process of moving the government back to Versailles. His time at Versailles was short, however. After his defeat at the Battle of Waterloo in 1815, Napoleon was removed from power. After Napoleon, Versailles was relatively forgotten. It wasn’t until the Revolution of 1830 and the July Monarchy that Versailles received significant attention. Louis-Philippe commissioned the creation of a museum at Versailles to unite the people of France. On his order, the prince’s apartments were destroyed, replaced by portrait galleries. The Gallery of Great Battles (1837) A portrait gallery made from the demolition of some of the royal apartments, the Gallery of Great Battles features 30 paintings that depict centuries of military success in France, beginning with Clovis and ending with Napoleon. It is considered to be the most important addition by Louis-Philippe to the Palace of Versailles. Mussolini Policies Essay a) Relations with the Catholic Church: Even though Mussolini had seemed anti-clerical and had written â€Å"God Does Not Exist† he had began forming a good relationship with the Roman Catholic Church because of its huge power and influence. He had begun forming this good relationship by getting married in a church in 1926 and having his two children baptized. He had also closed down some wine shops and nightclubs. In 1929 the Lateran treaty was signed after a series of meetings it had recognized the pope’s sovereign rule, the church had received 750 million lire cash and 1000 million lire in government bonds for the loss of the papal states in 1860. Catholicism had also become the state religion; church marriages became legal, religious education were a must in secondary schools, catholic action would continue as long as it was independent of political parties and it was subordinate to the church’s hierarchy. This treaty had gotten the church and it’s faithful followers on Mussolini’s side. However, this treaty had angered the radical fascists who were anti-clerical since the independence of the church meant there would be no totalitarian rule. The church had also been against communism and socialism therefore when the fascist destroyed the left this had brought Mussolini closer to the church. Mussolini had also strengthened this relationship by exempting the clergy from paying taxes in the mid 1920’s in return the Pius XI forced Dom Sturzo to resign since he was a fierce opponent of fascism. However, some friction remained between the fascist government and the Catholic Church as the catholic youth movements rivaled the fascist youth and student organizations. Moreover, some of the members of the catholic student organization were becoming influential and became significant leaders in the Christian Democratic Party in Italy after 1945 such as Aldo Moro in the 1930’s, which created problems for the fascists. The pope had also disapproved of the anti-Semitic laws introduced by Mussolini. However, he had approved of the invasion of Abyssinia in 1935 since it was similar to a crusade and his intervention in the Spanish civil war in 1926 to stop the Left. Mussolini’s relationship with the church remained well since they both gained a lot from their treaty. This policy had brought back the church’s power and had made Mussolini’s aim to build a new fascist generation impossible. b) Education and youth movements: Italian fascism like all other fascists had wanted to influence the young generation. In 1926 the Opera Nazionale Balilla was established bringing together fascist youth organizations and giving government funding. It was placed under the ministry of education in 1929 and they had begun closing rival youth organizations except the catholic youth groups. In 1932 the Ballila membership became obligatory. In 1937 the ONB joined with the young fascists to create one youth organization called Gioventu Italiana del Littorio for 6-21 year olds. The Ballila was political and it was militarized but it was also filled with sports and recreational activities, which attracted children, but 40% of the population had not joined showing the failure of this policy. At first Italian schools had some freedom but Mussolini had appointed the philosopher Giovanni Gentile to become the first minister of education. In 1923 Gentile had passed the education act which had changed education by promoting grammar schools, encouraging philosophy, classical studies and had not emphasized on technical and vocational education. To ensure that the schools would not spread anti-fascist ideas, anti-fascist teachers were removed and teachers were forced to take an oath of loyalty. Mussolini had started to really control schools in the mid 1930’s, as schools were obliged to use fascist textbooks. In 1936 there was also a history textbook that had to be taught which focused on promoting a part of Italian history that would create loyalty to Mussolini. Physical education was also important to have healthy kids who could go to war and be prepared for motherhood. Therefore, Mussolini had greatly impacted education in order to create loyalty to him. c) The battle of the births In order to make Italy a great power Mussolini had launched in 1927 a battle for the births so that Italy’s population could go from 37 to 60 million. The government started encouraging marriage by forcing more taxes on bachelors, awarding prizes to women with the most children, families with 10 or more children were exempted from paying taxes, loans were given to newly married couple, family allowances were introduced in 1934 finally the criminal code in 1932 had banned contraception, abortion and sterilization. This policy had failed since birth rate continued to fall in 1922 there was 147.5 births for every 1000 women of childbearing age while in 1936 it had fallen to 102.7 births. The population had only reached 44 million in 1940. However, this was only due to the falling of death rate and emigration but the government had failed to encourage early marriage as the average age at which they got married rose from the 1930’s. d) The media and the arts Mussolini wanted to suppress opposition so he started by censoring newspapers in 1923 and the fascists government had taken owned 10% of newspapers which meant it did not take over press but controlled what they wrote as the editors that would oppose him would be fined or banned from journalism. At first the fascist government saw radio and film as being insignificant but this changed when the government broadcasts increased and the ownership of radios went up to one million. Similarly, in 1924 a government film agency called Istituto Luce was created to make documentaries. In 1937 the government founded an Italian film studio called Cinecitta. However, Mussolini began really using propaganda in the 1930’s in order to form a new type of Italian, a heroic and energetic one. In 1925 the cult of the Duce was launched as was the biography of Mussolini called Dux. In this book Mussolini was presented as an athlete, hard working and loved the people. There were also many parades to elaborate rituals in order to revive roman spirit. The use of propaganda had aided Mussolini to become more popular in the years 1929-36. However, this popularity had begun to diminish once Mussolini became more radical as he applied the anti-Semitic policy and joined WWII. Mussolini did not get involved in art as much as Hitler had but there were division within the fascists as to which type of art to support. The neo-classicists preferred architecture and art that was inspired by ancient Rome while the modernists encouraged experimental art. Therefore, this lead to the formation of two artistic prizes, the Cremona prize for traditional art and propaganda while the Bergamo prize encouraged experimentation. To try to spread access to art the fascist government organized almost 50 art exhibitions a year. e) Racial policies (Anti-Semitic laws) Early on Mussolini had not shown any signs anti-Semitism however he had been racist against Africans in Libya and Abyssinia. One of the theories is that Mussolini had wanted to weaken the Jews because in the 1930’s he wanted to start a war and was not sure whether they would be loyal or not. Another theory is that in 1938 Mussolini was getting closer to Germany but while Hitler never pushed him to adopt anti-Semitism he might have chosen to adopt it in order to get closer to Hitler. Mussolini had started this policy by writing an article on reducing the number of Jews in 1938. He had then banned marriage between Jews and non-Jews, forbidden the Jews from jobs in civil service, teaching and PNF membership. The Jewish kids were also excluded from state schools and up to 10000 non-Italian Jews were deported. This law had caused Mussolini to become unpopular even within his own party who was made up of one third of Jews. The church that had a major influence had also criticized this law therefore making Mussolini even more unpopular. By 1941 6000 Italian Jews had left Italy among them were businessmen, professionals and academics therefore when they left the economy was badly affected. However, the corporations were just advisors that were dominated by fascists therefore they did what is best for them and left the worker’s interests aside. g) Conclusion Mussolini had adopted many policies that had gained him popularity and changed the Italian society such as the relationship with the church and influencing the media and the arts. However, when he had become more radical and adopted the anti-Semitic policy and tried to control education he had began losing popularity, which had eventually lead to his fall. To what extent was Mussolini influential in international affairs in the 1930’s? After the league of nations was undermined by the Manchuria crisis therefore when Hitler had began expanding and broke the treaty of Versailles by announcing his intention to build an army of 550000 men using conscription Mussolini decided to sign the stress front on 1935 with France and Britain. This stated that the three countries would take action if Germany broke the treaty of Versailles further. However, this agreement fell apart when Britain did not consult Italy or France before singing the Anglo-German naval agreement in 1935, which allowed Germany to expand its navy beyond what the treaty Versailles had allowed. Mussolini had also invaded Abyssinian, which Britain and France disapproved of. Therefore this shows that his international affairs with other countries had failed. Moreover, when Mussolini had invaded Abyssinia in 1935 it had changed his foreign policy completely his relationship with Britain and France was destroyed while his relationship with Germany was improving. Although Mussolini though France and Britain would not react to this invasion the League of Nations imposed economic sanctions since Britain was being undermined. However, Germany continued to trade with Italy and Mussolini ignored the sanctions therefore strengthening their relationship and weakening the league. In addition, Mussolini had also intervened in the Spanish civil war as he send 70000 troops to Spain to help support general Franco. Although he had failed he had sent them in order to weaken France who had a similar government as Spain and to have a naval base in the Balearic Islands to help promote Italian power in the Mediterranean. Furthermore, Mussolini’s relationship with Germany had also been strengthened as they had signed the Rome-berlin axis. Italy had also walked out of the League of Nations as Germany had done. It is also said that Mussolini had adopted the anti-Semitic policy in order to get closer to Germany and to make Italy more radical. As Mussolini became closer to Hitler he had changed his foreign policy towards Austria as he allowed Germany to increase its influence over Austria. In 1938 after the newly appointed chancellor Seyss-Inquart had invited Hitler to send troops, Hitler had attacked Austria and Mussolini had not rejected. Moreover, when a crisis broke out because Hitler had wanted to invade Czechoslovakia after he demanded that the Czech government allow the German speaking are of Czechoslovakia to unite with Germany. Therefore, it seemed that Britain and France would side with Czechoslovakia therefore causing war. Mussolini played the role of peacemaker and set up the Munich conference in 1938. Mussolini was also encouraged by Britain and France’s appeasement of Hitler to avoid aggression to start a more violent foreign policy. Mussolini had also been aware of him being the weak partner in the Italian-German relationship therefore this encouraged him to become violent to be more influential. The Connection Between Homelessness And Social Issues Social Work Essay Essay Question What is the connection between homelessness, unemployment, drug use and mental illnesses in Australian society today? Unfortunately, in Australian society today, it is assumed that all Australians have access to a safe and secure environment, and are able to seek and gain employment; however this is not always the case for many Australians, with these social detriments being exacerbated by mental health issues and alcohol and drug abuse. However, in saying this not everyone that experiences one or more of these detriments necessarily experiences another. Alternatively, evidence has shown that there is an obvious link between each of these social and health detriments of health, with each intricately leading to another. This essay will discuss the intricate links between homelessness, unemployment, drug use and mental illness in todays society. On any given night in Australia it is estimated that over 100,000 people are homeless and living without essential human rights. (MHCA, 2009. p.5) While the reasons for peoples homelessness are varying, the abuse of alcohol, drugs and other harmful substances can exacerbate the situation and lead to further problems. The use of harmful substances by many homeless people is often seen as functional, this meaning that the use of these substances is helping them cope with their situation, and provide them with a sense of belonging in the Australian street culture. While many of the homeless people may start using soft drugs , this often opens the gateway to harder substances to which they can come completely reliant upon. The prevalence of heroin use in the homeless community is ten times higher than the general Australian community. (Australian National Council on Drugs, 2008) (Johnson Chamberlin, 2008, p.347) Australias homeless population, exhibit higher rates of emotional and physical health issues, anxiety, poor nutrition and difficulties in maintaining relationships (Lady Bowen Trust). 1 in 200 Australians in todays society dont have access to adequate housing and employment. It is estimated that 75 percent of this homeless population is suffering from some kind of mental illness, (MHCA, 2009, p.5) and that at least forty three percent engaged in substance abuse. (Johnson Chamberlin, 2008, p.347) A safe and secure environment is essential to physical and mental health. Mental health symptoms can often be worsened by unstable housing and social isolation. Homelessness significantly affects a persons ability to successfully maintain employment and relationships. When referring to mental illness, generally speaking it is an illness that has some kind of influence and effect on how a person, thinks, feels and acts. (MHCA, 2009, p.10) These can include mental health issues such as depression, anxiety personality disorders, schizophrenia and stress disorders. It is estimated that 1 in 5 people will experience a mental illness of varying degrees at some point in their lives. (MHCA, 2009, p.10) Although the exact cause of many mental illnesses are unknown, along with biological factors it is believed that environmental factors, stressful and abusing situations, substance or drug abuse and negative thought patterns all contribute to a persons mental health. Domestic violence, mental health, unemployment and substance abuse are among the leading causes of homelessness in Australia, along with critical shortages of affordable housing. However it is important to note that there are many contributing factors to a person becoming homeless such as family breakdown, sexual assault, gambling, mental illness, financial difficulties and social isolisation and broader social processes. (Homelessness Australia, 2010) Having a mental illness reduces a persons quality of life; the symptoms can make it difficult for individuals to cope with the daily demands of work and home life. In some cases this can lead to people becoming socially isolated, and even losing their jobs. This loss of employment often means people are no longer able to afford housing and a lack of social support can mean these people may become homeless. The unemployed are also less likely to receive medical treatment for symptoms of mental illness. If they do seek treatment of these illnesses they then face the problems of being able to pay for expensive prescriptions. (www.informahealthcare.com) The current economic climate has also placed increased stress on individuals and there has been a spike in Medicare claims for mental health consultations due to unemployment (Dragon, 2009). Studies have shown that homeless people have a higher prevalence of mental illness and substance abuse, with a Melbourne study showing 30 percent of homeless people surveyed had mental health issues and 43 percent suffered substance abuse issues. (MHCA, 2009, p.14) Substance abuse is also linked to homelessness, unemployment and mental illness, as substance abuse can take hold and damage a persons quality of life. Substance abuse begins to interfere with a individuals work and social life and this commonly leads to the destruction of relationships and loss of employment. Rather than this slide from positive relationships and employment being instant, many people tend to slide into homelessness as a result of their substance abuse. As they begin to come more dependent on these substances the transition becomes more rapid. ((Johnson Chamberlin, 2008, p.348) Having a mental illness can increase a persons likelihood of abusing drugs, which may in the short term make the symptoms of their mental illness feel better, while other peoples drug use can trigger the symptoms of mental illness. (MHCA, 2009, p.22) The link can also be made in terms of unemployment and homelessness, if a person is unemployed they can experience financial difficulties that can result in being homeless, alternatively if a person is homeless it becomes difficult to gain employment and break the cycle. The relationship between homelessness and substance abuse is well researched and documented; there is debate however on the direction of this relationship, and whether substance abuse is the cause or consequence of an individual becoming homeless. The focus of substance abuse as a consequence of homelessness is the social adaption model. Entering into homelessness often exposes individuals to a subculture where substance abuse is accepted and common place. This model also identifies that many people start to abuse substances as a method of coping with their situation, which can often be very stressful, uncertain and traumatic. (Johnson Chamberlin, 2008, p.343) Johnson and Chamberlain (2008, p.350) report that thirty four percent of individuals have engaged in substance abuse before becoming homeless, while sixty six percent first start abusing substances after becoming homeless.es as they struggle to pay for their addiction. Loss of employment then leads individuals looking for alternative income which can often lead to bad loans and illegal behaviours. (Johnson Chamberlin, 2008, p.p347-350) The social selection approach focuses on substance abuse as a cause of homelessness rather than a consequence. Substance abuse can be a leading factor into homelessness, as when a person becomes addicted to harmful substances they tend to start self damaging behaviours which affect social and work relationships. As their substance abuse increases, this often leads to financial difficulties and destruction of social networks. Psychological trauma and post traumatic stress disorder have been found to be contributing factors for many of the homeless population. There is no specific way in which each of these social detriments of health contributes to each other. For example, mental health issues may contribute or lead to people becoming homeless, while for others their mental health issues may be a result of being homeless or compounded by it. (MHCA, 2009, p.22) The homeless population can face discrimination when trying to find and apply for housing, especially when they have experienced a mental illness. (DHA, 2005) Many landlords are something about having people with a mental illness in their accommodation, due to the negative stigma that is attached with mental illness. Having a mental illness or past substance abuse problem can also follow a person and impact upon their lives even after they have overcome these issues. As in todays society many jobs and housing applications require police, credit and background checks. (MHCA, 2009, p.18) Webster (2007) reports that drug abusers with mental illnesses are likely to experience high rates of employment difficulties. Stating that individuals with mental illnesses have fewer work-related skills, poor interpersonal skills, impulse control and poor time management, therefore having less success in the workforce than individuals without mental illness and substance abuse issues. (Webster et al., 2007) Webster (2007) also reports that employment is a key factor in breaking the cycle of drug abuse, as employment occupies time, increases self esteem, promotes a sense of belonging and responsibility and provides structure. (Webster et al., 2007) In Australian society a quarter of the homeless population are children aged between 12 and 18, as these children age and mature they are at a higher risk of unemployment and being stuck in a vicious cycle of homelessness, unemployment, substance abuse and mental illness. (Graham, 2010, p.24) Children are more likely to face unemployment if they are from low socioeconomic status, left school early leading to low literacy and numeracy skills, are indigenous, live with one or more unemployed person, or live in remote areas. (Graham, 2010, p.20) A longitudinal study of Australian youth with mental health issues found that they did not suffer from mental health issues prior to unemployment. This shows the importance of employment and the effect that unemployment can have. (Graham, 2010, p.23) In 1991, Fischer Breakey developed three pathways into homelessness. The first being social selection which involves a breakdown in the capacity for living independently due to mental illness. The second pathway details socioeconomic adversity in which a person experiences unemployment, low levels of education and declining income. The third pathway described involves the inability to develop socially normative roles and support systems. (Kim Ford, 2010, p.40) The sociological imagination uses a sociological approach to analysing issues such as homelessness, substance abuse, unemployment and mental illness. This approach analyses associations of public issues and personal problems by looking at the Historical, structural, critical and cultural factors which contribute to a person experiencing issues such as homelessness. A better understanding of the causes can be found and thus leading to a better understanding of how to return to normal societal function and reducing the risk of relapse into past behaviours. . (Germov, 2009, p.7). The amount of structure and agency an individual holds in situations of homelessness, drug abuse, unemployment and mental illness is also important to note. The structure agency debate explores the amount of control a individual has over their behaviour and how much influence the social structure to which they belong plays. (Germov, 2009, p.7). Children that have grown up in an environment which is socioeconomically disadvantaged, high levels of drug abuse and unemployment, and poor work ethic, are more likely to follow in this pattern than children that have been brought up in higher socioeconomic conditions and have been instilled with a strong work ethic. Sue is 17 years of age and has been living away from home for two years, having left her family home due to conflict and violence with parents and physical assault between siblings. In the past two years Sue has lived a typically transient lifestyle, residing in crisis accommodation, various boarding arrangements and in an accommodation program to assist young people who are homeless and in need of specialist support. Sue has lived independently in a small unit as well as with a number of friends in their accommodation and in squats. Over the past two years Sue has engaged in self-harming behaviour and been violent and aggressive towards peers, herself and family, which has on occasion resulted in cautions from the legal system. Sue has also engaged in petty theft, auto-theft and break and enters, all resulting in legal cautions. Sue uses alcohol, marijuana and amphetamines and has been diagnosed with depression resulting in anti-depressants being prescribed (Mission Australia, 2005). In December 2008, the Australian Government released a White Paper on Homelessness: The Road Home: A National Approach to Reducing Homelessness. This paper recognises that maintaining the current approach to homelessness will see the homeless population of Australia significantly increase in the coming years. The paper takes a holistic view and aims to find solutions in address the varying needs of the homeless population, for example employment needs, education and training, health and social support. This report has three main initiative areas. They are to ensure that services intervene early to stop people becoming homeless, making services more connected and responsive across a range of areas not limited to housing, such as health and economic and social participation and strategies to assist people who become homeless to move quickly through the crisis system to stable housing, and providing the support they need so that they do not re-enter homelessness. Through the implementat ion on many straggles under these initiatives and 1.2 billion dollars in funding the Australian Government aims to have a fifty percent reduction in homelessness by 2020. (MHCA, 2009, pp.12-13) Todays society has negative stigma and labelling associated with homelessness. Due to this attributes, the skills they poses, their personality, past achievements are often disregarded and overrun by the fact they are homeless. (Mission Australia, 2005) As homelessness is not a social norm, it can be seen is deviant behaviour. With the rise of the medical model of health, importance is placed on the individual receiving treatment in order to restore health and conformity. (Roach Anleu, 2010, pp.242-260) Under the therapeutic model deviant individuals which can include the homeless, mentally ill, drug and alcohol abusers and those experiencing adjustment problems require psychiatric intervention, with little emphasis in the social and environmental conditions that contribute to these issues. (Roach Anleu, 2010, pp.242-260) Homelessness, unemployment, drug use and mental illness are all intricately connected in todays society. These social determinants of health all coexist and can each weigh largely upon another. These linkages can lead to a viscous cycle which can be hard to break. Julius Caesar: Flawed Models of Leadership Leadership is a recurrent theme in Shakespeare's Julius Caesar. The play is centred on a group of men in leadership positions. The political setting and mood of Julius Caesar, lend itself well to Shakespeare's insights into the human condition. As the players' personalities develop through the course of the play, we see that his portrayal of their character-types (which still endure today) is both consistent and accurate. Julius Caesar has many fine examples of arrogance in leadership. We see Caesar's pretensions as quite laughable. "But I am constant as the northern star, of whose true-fix'd and resting quality there is no fellow in the firmament", and "the things that threaten'd me ne'er look'd but on my back: when they shall see the face of Caesar, they are vanished" demonstrate his pride. Shakespeare suggests that although being 'sure of yourself' is a necessary characteristic for a good leader (as it enables decisive action and 'courage'); it should also be tempered with humility. The confidence of a leader, in turn, instils confidence in his/her followers. The quote, "And men are flesh and blood, and apprehensive; yet in the number I do know but one that unassailable holds on his rank, unshaked of motion: and that I am he", is an example of the comfort and security that his words provided the common people. Caesar's absolute faith in his greatness and right to rule was in the perfect climate, in the midst of a community that was seeking a 'ruler'. The followers were more sheep than thinker... ...other conspirators as traitors, the crowd is wild. Antony's transparent "sweet friends let me not stir you up to such a sudden flood of mutiny" is just the beginnings of his carefully-orchestrated urgings to them. When he finally sets them loose, it is with a "Now let it work. Mischief, thou art afoot, take thou what course thou wilt!"- an exclamation which sounds 'heartstrong', but not very well-thought out. Shakespeare advises that such a leader can be dangerous. Through a well-developed cast and a complex play about men, politics and power; Shakespeare has once again demonstrated his mastery of the humanity of the characters he creates. The flawed models of leadership we examine in Julius Caesar aptly lend themselves to the theory that "an imperfect world gives power to imperfect men".
